March 28, 2015: Indian LED player Eveready won the court case against Havells on its LED lighting advertising campaign. In the advertisement campaign, Eveready compared its LED bulbs on three parametres?lumens per watt (/), lumens and MRP vis-a-vis similar LEDs from its competitors including Phillips, Syska, Bajaj, Halonix, Surya Roshni and Havells.
The ad campaign by Eveready, which says “check lumens and price before you buy”, invited consumers to compare two major features of an LED bulb, which is lumens and price.
Havells contested the ad saying that lumen was not the lone parameter to judge the value of an LED bulb and said that the ad was misleading.
However, Delhi High Court, in its judgment dated March 17, 2015, dismissed Havells’ appeal, saying that the “advertising campaign is not misleading” and “the factors compared are material, relevant, verifiable and representative features.”
Eveready, a battery manufacturer in India, is currently focusing on LED bulbs as it believes that the company can increase its profit margin in the LED lighting market.
